About This Settlement

A class action lawsuit alleged that Toyota sold internal combustion (IC) forklifts that were not certified to meet emissions standards, forcing purchasers and lessees to pay for emissions-related repairs and other associated costs. Toyota has not admitted any wrongdoing in connection with these alleged defects. To resolve these allegations, Toyota agreed to a $299.5 million settlement in the case Broadmoor Lumber & Plywood Co., et al. v. Toyota Industries Corp., et al. (Case No. 3:24-cv-06640-JSC). Who Qualifies

• You may be eligible to participate in this settlement if you meet all of the following criteria:
• You are an individual or business entity that purchased or leased a Toyota forklift powered by an internal combustion (IC) engine
• Your forklift was built between 2007 and 2021 and sold in the United States
• Your forklift contains one of the following covered engine types and certification years:
• • 2014–2021 model year 1KD engine
• • 2014–2021 model year 1ZS engine
• • 2013–2021 model year 1FS engine
• • 2007–2021 model year 4Y engine
• You are able to provide proof of purchase or lease, including the forklift's model number, serial number, and documentation confirming ownership or lease

What You May Receive

If you submit a valid claim, you may receive the following benefits for each eligible forklift:

• Cash Payment: An estimated $1,000 to $2,500 per eligible forklift. The exact amount you may receive depends on the total number of valid claims filed and is not guaranteed. • Free Service Plan Visit: One complimentary service plan visit per operable forklift, covering labor and travel costs. • New Parts Warranty: In the event of a government-approved recall, you may be entitled to a new parts warranty.

Individual payout amounts are not guaranteed and may vary based on claim volume and other factors.

How to File a Claim

2. Gather your required documentation, including the model number and serial number of each eligible Toyota IC forklift, along with proof of purchase or lease confirming your ownership.
3. Complete the claim form accurately and in full, providing all requested information about each forklift for which you are filing a claim.
